1. Aceptación de estos términos

Estos términos de servicio ("Términos") rigen el uso del sitio ginviewer.dhatek.com, de la aplicación de escritorio GinViewer y de los servicios relacionados (el "Servicio"), ofrecidos por DHATEK ("DHATEK", "nosotros"). Al instalar, iniciar sesión o usar GinViewer, usted ("el médico", "la clínica" o "usted") acepta estos Términos. Si no está de acuerdo, no debe usar el Servicio.

2. Descripción del Servicio

GinViewer es una aplicación de escritorio para consultorios de ginecología que permite visualizar imagen en vivo de colposcopio/ultrasonido, capturar hallazgos, gestionar expedientes e historias clínicas, generar reportes y recetas en el formato de la clínica, e imprimirlos o enviarlos a la paciente. GinViewer está dirigido exclusivamente a profesionales de la salud y personal autorizado de una clínica; no está dirigido al público en general ni sustituye el juicio clínico del médico tratante.

3. Cuenta, licencia y periodo de prueba

Cada médico utiliza el Servicio bajo una cuenta individual, incluyendo, si así lo habilita, el inicio de sesión con Google. Usted es responsable de mantener la confidencialidad de sus credenciales y de toda actividad realizada desde su cuenta. DHATEK otorga una licencia de uso no exclusiva, intransferible y revocable sobre la aplicación, sujeta al pago de la suscripción vigente una vez concluido cualquier periodo de prueba gratuito ofrecido (p. ej., los primeros 3 meses). DHATEK puede suspender una cuenta ante sospecha de uso indebido, impago o incumplimiento de estos Términos.

4. Responsabilidad sobre los datos clínicos

El médico o la clínica es el único responsable de: (a) contar con el consentimiento y la base legal necesarios para capturar, almacenar y transmitir los datos de sus pacientes; (b) la exactitud de la información clínica capturada; (c) resguardar el equipo donde se almacenan los expedientes (ya que se guardan localmente, cifrados, en dicho equipo); y (d) el envío de reportes o recetas por correo electrónico o WhatsApp, realizado siempre desde la propia cuenta del médico. DHATEK no accede, revisa ni controla el contenido clínico capturado por los usuarios.

5. Uso aceptable

Usted se compromete a no: (a) utilizar el Servicio para fines distintos a la práctica clínica legítima; (b) intentar vulnerar, descompilar o eludir los mecanismos de licenciamiento o cifrado del Servicio; (c) revender, sublicenciar o distribuir el Servicio a terceros sin autorización escrita de DHATEK; ni (d) usar el Servicio de forma que infrinja la normativa de protección de datos personales de salud aplicable en su jurisdicción.

6. Propiedad intelectual

El software, el diseño, las marcas "GinViewer" y "DHATEK", y todo el material relacionado son propiedad de DHATEK o de sus licenciantes. Estos Términos no le transfieren ninguna propiedad intelectual sobre el Servicio; usted conserva la titularidad de los datos clínicos de sus pacientes que capture con la aplicación.

7. Disponibilidad y limitación de responsabilidad

GinViewer está diseñado para seguir funcionando sin conexión a internet para las funciones principales de la consulta. No obstante, el Servicio se proporciona "tal cual" y "según disponibilidad", sin garantías de que será ininterrumpido o libre de errores. En la medida permitida por la ley aplicable, DHATEK no será responsable por daños indirectos, incidentales o consecuentes derivados del uso del Servicio, incluyendo pérdida de datos por fallas del equipo del cliente, cortes de energía o uso indebido de la aplicación. GinViewer es una herramienta de apoyo administrativo y de documentación; no sustituye el criterio clínico ni la responsabilidad profesional del médico tratante.

8. Vigencia y terminación

Estos Términos estarán vigentes mientras usted utilice el Servicio. Usted puede cancelar su suscripción en cualquier momento contactando a contacto@dhatek.com. DHATEK puede terminar o suspender su acceso por incumplimiento de estos Términos, previo aviso cuando sea razonablemente posible. Al terminar, usted conserva el acceso a los expedientes almacenados localmente en su equipo; DHATEK no tiene copia de ellos salvo que haya activado expresamente un respaldo en la nube.

9. Cambios a estos Términos

Podemos actualizar estos Términos para reflejar cambios en el Servicio o en la normativa aplicable. La fecha de "última actualización" en la parte superior indica la versión vigente; cambios sustanciales se notificarán por correo o dentro de la aplicación antes de entrar en vigor.

1. Acceptance of these terms

These terms of service ("Terms") govern the use of the website ginviewer.dhatek.com, the GinViewer desktop application and related services (the "Service"), offered by DHATEK ("DHATEK", "we"). By installing, signing in to, or using GinViewer, you ("the physician", "the clinic", or "you") agree to these Terms. If you do not agree, you must not use the Service.

2. Description of the Service

GinViewer is a desktop application for gynecology practices that lets you view live colposcope/ultrasound imaging, capture findings, manage patient records and clinical histories, generate reports and prescriptions on the clinic's own format, and print or send them to the patient. GinViewer is intended exclusively for health professionals and authorized clinic staff; it is not intended for the general public and does not replace the treating physician's clinical judgment.

3. Account, license and trial period

Each physician uses the Service under an individual account, including, when enabled, signing in with Google. You are responsible for keeping your credentials confidential and for all activity under your account. DHATEK grants a non-exclusive, non-transferable, revocable license to use the application, subject to payment of the applicable subscription once any offered free trial period ends (e.g., the first 3 months). DHATEK may suspend an account on suspicion of misuse, non-payment, or breach of these Terms.

4. Responsibility for clinical data

The physician or clinic is solely responsible for: (a) having the consent and legal basis needed to capture, store and transmit their patients' data; (b) the accuracy of the clinical information captured; (c) safeguarding the equipment where records are stored (since they are kept locally, encrypted, on that equipment); and (d) sending reports or prescriptions by email or WhatsApp, always done from the physician's own account. DHATEK does not access, review or control the clinical content captured by users.

5. Acceptable use

You agree not to: (a) use the Service for purposes other than legitimate clinical practice; (b) attempt to breach, decompile or circumvent the Service's licensing or encryption mechanisms; (c) resell, sublicense or distribute the Service to third parties without DHATEK's written authorization; or (d) use the Service in a way that violates applicable health-data protection regulations in your jurisdiction.

6. Intellectual property

The software, design, the "GinViewer" and "DHATEK" marks, and all related material are owned by DHATEK or its licensors. These Terms do not transfer any intellectual property in the Service to you; you retain ownership of the clinical data you capture with the application.

7. Availability and limitation of liability

GinViewer is designed to keep working offline for the core consultation features. That said, the Service is provided "as is" and "as available", with no guarantee that it will be uninterrupted or error-free. To the extent permitted by applicable law, DHATEK will not be liable for indirect, incidental or consequential damages arising from use of the Service, including data loss from the client's equipment failure, power outages, or misuse of the application. GinViewer is an administrative and documentation support tool; it does not replace the treating physician's clinical judgment or professional responsibility.

8. Term and termination

These Terms remain in effect while you use the Service. You may cancel your subscription at any time by contacting contacto@dhatek.com. DHATEK may terminate or suspend your access for breach of these Terms, with notice when reasonably possible. On termination, you retain access to the records stored locally on your own equipment; DHATEK holds no copy of them unless you have explicitly enabled a cloud-backup feature.

9. Changes to these Terms

We may update these Terms to reflect changes to the Service or to applicable law. The "last updated" date at the top indicates the current version; material changes will be notified by email or inside the application before taking effect.
